Terms and Conditions

1.General

A) By signing the admissions form, all agree to the following terms and conditions of Optimal Tutors Limited, T/A Optimal Tutors, 11A Memorial Road, Walkden, Worsley, Manchester, M28 3AQ.

B) The terms 'you', 'your' or 'customer' refer to the parent/guardian/student. The terms 'we', 'us/our', 'Optimal Tutors', 'the company' refer to Optimal Tutors Limited.

C) The admissions form & these terms and conditions constitutues the contract between the parties being the student and/or the parent/guardian of the student and Optimal Tutors.

D) The headings contained in the agreement are for convenience only and do not affect their interpretation.

E) Acceptance of a student for enrolment is at the discretion of Optimal Tutors. A student must satisfy the requirements of Optimal Tutors (by taking an assessment) that his or her level of work and behaviour have reached Optimal Tutors standards.

F) By enrolling with Optimal Tutors, the parent authorises Optimal Tutors and/or its representatives to pubish photographs and materials relating to the students enrolment e.g exam results, in all territories for the purposes of publicity and promotion without restriction unless otherwise agreed.

G) Optimal Tutors reserves the right to modify tuition fees from time to time. (Reasonable notice will be given to the parties concerned).

H) We may modify any of these terms and conditions within this agreement at any time at our sole discretion. Any such change will be given at least 30 days notice. If any of the modifications are unacceptable to you, then the only course of action is to terminate tuition with Optimal Tutors. If Optimal have received no notice after 30 days that the modifications are unacceptable, it will be considered that you accept the modifications made.

I) Students or parents/guardians are required to notify the office of any change of address, contact details & if the student is diagnosed with any medical conditions or is prescribed medication during the duration of sessions with Optimal Tutors


2. Tuition Fees

A) Tuition fees are usually calculated on an hourly tuition rate and vary depending on the subject level(s) undertake.

B) The method and frequency of payment is stipulated in the admissions form. Payment structures are as follows:-Pay as you go- Pay full tuition fee for classes attended,. No compensation, refund or adjustment in fee for authorised/unauthorised absense(s).

-Issues regarding fees and services should be addressed only by the student/parent/guardian to the management and not at any time to the tutors.

-No personal correspondence is allowed between students/parents/guardians and the tutor. All correspondence must be through the administration only.

-Tuition fees must be paid 72 hours before the tuition commences. This can be through debit/credit card payment or bank transfer. For details on bank transfer payment, please contact the administration team,

-HMRC Childcare: parents claiming childcare costs will still pay the full rate of tuition based on the students academic year.

C) If fixed hours and tuition rates have been agreed and then been reduced, the hourly rate may increase and discount given may become invalid.

D) For more information about tuition fees and how to pay tuition fees, please speak to member of the admissions team.


3. Examination Fees

A) All tuition/admission fees, deposits and/or charges are set out in clauses 2 and 4 of these terms and conditions and exclude amounts payable to professiona bodies for student registration, exemptions and examination entries, which are (except as stated) payable by the student and Optimal Tutors accepts no responsibility for these.

B) Any internally assessed examination and

computer based examination fees are payable by the student/parent/guardian and are non transferable or non- refundable. Any such fees may include disbursements payable to the relevant examining body amd a handling fee by Optimal Tutors.

C) It is the responsibility of the student/parent/guardian to ensure the exam entry form(s) are completed 3 months prior to the start of the examination period. Optimal Tutor will endeavour to display relevant exam entry deadlines for each awarding body on its notice boards.

D) Exam entry(((((s) should clearly state each exam(s) the student would like to be entered for.

E) It is the responsibility of the student/parent/guardian to ensure exam entries are processed in a timely manner and to obtain a statement of entry before the deadline from the Exams Office.

F) Students/parents/guardians will be charged late entry fees if forms are submitted after the deadline.

G) Acceptance of any exam entries is at the absolute discretion of Optimal Tutors.


4. Admission Fees, Deposits and Charges

A) All stationary, including books and other writing materials should be purchased by the student/parents/guardians or will be charged separately by Optimal Tutors.

B) Optimal Tutors reserves the right to withhold any or all despoits until all payments have been cleared. This includes but is not limited to payment of fees, stationary, books and fines.


5. Refunds, Compensation Classes and Adjustment in Fees

A) In the case of an unauthorised absence, Optimal Tutors will only compensate in re-arranged classes if the student/parent/guardian wishes to be compensated.

B) Any absence without 72 prior notice of any session will be deemed as an unauthorised session.

C) Students/parents/guardians will be not eligible for refunds/compensation classes/adjustment in fees in cases of unathourised absences but may be liable to pay full tuiton rate fee.

D) The company reserves the right to retain/demand payment for classes missed due to unauthorised absence.

E) Any authorised absence may only be compensated in the form of classes.

F) Compensation classes can be booked during half-term, Christmas, Easter, Summer breaks and specific class times.

G) Compensation classes may be used for any subject of the students choice provided that the student is enrolled for the specific Subject.


6. Cancellation/Termination

A) Optimal Tutors reserves the right to cancel an enrolment and allocate the place to another applicant in cases of non payment of tuition fees, 3 weeks unauthorised absence, unacceptable misconduct (on the part of the student/parent/guardian or representative of student/parent/guardian) or due to any material breach of contract by student/parent/guardian.

B) No fees or deposits will be refunded where a students enrolment has been cancelled under claused 7.

C) Any cancellation or termination made by Optimal Tutors of the contract will be made in writing.

D) If a student/Parent has had session(s) beyond the first session they are liable to give a notice equivalent to two sessions before the agreement.

E) Payments for sessions are non refundable no matter the circumstances even if the sessions are booked in less than 24 hours to the session.


7. Classes

Optimal Tutors reserves the right to alter courses or programmes, tutors or speakers, dates or locations and/or cancel or change lessons at its discretion.


8. HMRC Childcare Customer.

These terms and conditions coincide with any HMRC contratcs entered into prior or following this contract.


9. Force Majeure

Optimal Tutors shall not be liable for any breaches of its olbigations under this agrrement resulting from causes beyond its reasonable control such as fire, flood, explosion or other catastrophes.


10. Liability

A) Students/parents will be held responsible for any loss, theft or damage to Optimal Tutors property however caused by them

and wil fully indemnify Optimal Tutors against resulting liabilities and expenses.

B) Optimal Tutors does not provide any guarantee or accept any responsibilty or liability for the following:

-students outside Optimal Tutors premises

-the safekeeping of exam results and certificates

-exam/coursework/contrleed assessment or other results

-availability of the service Optimal Tutors provides or space within a course or class

-any losses,damage,death or personal injury or consequential loss ecept for those resulting from Optimal Tutors negligence or breach of duty

C) Optimal Tutors reserves the right to recover overdue fees,charges, or other monies, as part of its debt recovery process. In these circumstances, your liability to pay may be increased by additional fees and charges such as the cost of taking the matter to court or instructing debt collectors.


11. Disclaimer

A) Our prospectis, adverts, social media and website are not contractual documents. While Optimal Tutors endeavours to ensure that the information on these mediums are correct, we do not warrant the accuracy and completeness of the material in them. We may make changes to the material on the site or the services, products and prices described in it at any time without notice.

B) The material on the site/adverts is provided 'as is', without any conditions, warranties or other terms of any kind. Accordingly, to the maximum extent permitted by law, Optimal Tutors site is provided on the basis that we exclude all representations, warranties, conditions and other terms (including, without limitation, the conditions implied by law of satisfactory, fitness for purpose and the use of reasonable care and skill) which apart from this legal notice might have effect

in relation to the Optimal Tutors site.


12. Miscellaneous

A) Optimal Tutors has limited reserved parking spaces to the rear of the building. Optimal Tutors is not liable for any loss or

damage of any kind.

B) Optimal Tutors over time is liely to undego a number of changes, whether internally such as class size, staff or premises changes or externally such as mergers or reorganisation. For these reasons the benefit and burden of this agreement may be freely assigned to another party at the discretion of Optimal Tutors. It is not practisable to consult with parents or students over every change that may take place. Whenevr practiceable, Optimal Tutors will use reasonable endeavours to ensure all students/ parents and guardians are informed of changes.

C) If any words above or in combination infringe the Unfair Terms in Consumer Contracts Regulations 1999 or any provision

of law, they shall be treated as severable and shall be replaced with words which give as near tehe original meaning as may be as fair.


13. Data Protection

Parent/guardians/students consent to Optimal Tutors obtaining, processing and holding personal data including sensitive

personal data such as medical information to be processed lawfully and fairly in accordance with the Data Protection Act 1998. For the purposes of safeguarding and promoting the welfare of students and ensuring that all

relevant legal obligations of Optimal Tutors and its parents are comlied with.


14. Jurisdiction

These terms and conditions are governed exclusively by British law.


15. Declaration

I declare that the information given on tis admissions form is true and accurate to the best of my knowledge. I understand that any false, inaccurate or misleading information given on the admissions form may make this application void. I have understood and accepted the above Terms and Conditions.
